Foreigners' affairs

Foreign nationals who wish to reside permanently in Germany are subject to the requirement of a residence permit (visa, EU Blue Card, residence permit, settlement permit) as well as the passport requirement.

In principle, an application is required for a residence permit. You can submit this to the Foreigners' Registration Office of the City of Lahr.

Special feature of residence permits for students:

A visa is generally required to enter Germany to study. Exceptions are EU nationals and citizens of the USA, Australia, Israel, Japan, Canada, New Zealand, Switzerland, El Salvador, Brazil and South Korea. The following information and documents must be provided as part of the visa procedure:

  • Indication of the place of study, the study institution, the study program and the field of study
  • Indication of whether it is a postgraduate, additional or supplementary course of study or a doctorate
  • Submission of the letter of admission or a study reservation
  • Proof of sufficient means of subsistence (BAFöG standard rate, calculated for one year or scholarship)
  • Basic knowledge of the German language

Special feature Residence permit for EU nationals and Swiss nationals:

All EU nationals do not require a visa to enter Germany. Unrestricted freedom of travel applies here. EU citizens and their family members who meet the requirements for freedom of movement have the right to enter and reside in Germany. Family members who are not EU nationals (= third-country nationals) are issued with a residence card certifying their right of residence. Swiss nationals entitled to freedom of movement and their family members receive a corresponding residence permit.

The Citizens' Service is responsible for the police registration of EU nationals in Lahr.

Special feature of the "EU Blue Card" residence permit

On 1 August 2012, the EU Blue Card was introduced as a new residence permit for foreigners with a German or recognized foreign university degree. It can be limited to four years if an employment contract with a sufficient salary is presented and the Federal Employment Agency agrees.

To obtain an EU Blue Card, the following documents must be submitted to the ABH of the city of Lahr:

  • a current biometric passport photo
  • passport
  • tenancy agreement
  • Employment contract + the last three payslips

Special feature residence permit for self-employed persons

Under certain conditions, foreigners can be granted a residence permit for self-employment.

The following documents must be submitted to the Foreigners' Registration Office of the City of Lahr when applying for a permit:

  • valid national passport or identity card
  • a current biometric passport photo
  • Development concept for the business idea
  • Profit statement from a tax consultant
  • Rental agreement or, in the case of owner-occupied property, an extract from the land register or purchase contract
  • Proof of health insurance cover
  • Proof of adequate pension provision if you are over 45 years old

The settlement permit is an unlimited residence title and entitles the holder to pursue gainful employment of any kind. There are various requirements for this.

These are normally

  • Possession of a residence permit for five years
  • secure livelihood
  • Payment of pension insurance contributions for at least 60 months
  • No significant criminal convictions
  • Sufficient living space
  • sufficient knowledge of the German language and legal system (integration course - B1 certificate)

In principle, all new immigrants who are permanently residing in Germany for work purposes, for the purpose of family reunification or as refugees should benefit from the language support services. There is no entitlement for children, adolescents and young adults who are starting a school education or continuing their school career in Germany.

The obligation or entitlement to language and integration courses is issued by the Aliens Department of the City of Lahr when the residence permit is first issued.

Language courses are offered by the adult education center of the city of Lahr, among others.

Under certain conditions, naturalization can take place after an application has been submitted. Children born in Germany automatically receive German citizenship under certain circumstances.

Applications for naturalization can also be obtained from the citizens' service of the city of Lahr

Application to change or cancel the residence requirement for recognized persons (persons entitled to asylum, refugees, persons entitled to subsidiary protection):

  • Submit an application to change or cancel the residence requirement to the authority where the residence is currently established.
  • Proof of residence at the destination address.
  • Submission of employment contract (at least 820.00 euros net salary and at least 15 hours per week). Add payslips, if these are already available.

Or:

  • Proof that spouse, registered partner or unmarried minor children live at the destination address.

Or:

  • Proof of particular hardship.
