Submit a declaration of commitment

Introduction

You can submit a declaration of commitment for the issue or extension of a visa or residence permit. This also applies to stays for business purposes.


This means that you undertake to bear the costs of the foreigner's living expenses for a period of five years.


This means that you will reimburse all public funds incurred for living expenses, including housing and care in the event of illness or the need for care, even if the expenses are based on the foreigner's legal entitlement.
This also applies to a possible return journey to the home country (departure or deportation costs).

The period of five years begins with the entry of the foreigner made possible by the declaration of commitment.


The declaration of commitment expires neither through recognition as a person entitled to protection under the Asylum Act nor through the granting of another humanitarian residence permit.

Procedure

You must submit the declaration of commitment in writing to the Immigration Office. The declaration must be signed by hand.


You can obtain the form from the responsible office.


Note: Natural persons, but also legal entities such as companies or charitable associations, can submit a declaration of commitment.


The foreigners authority will check your creditworthiness as part of the procedure.


The obligation arising from the declaration of commitment is enforceable.

Required documents


  • Passport or identity card

  • current proof of earnings for the last three months of the inviting party or savings book

  • in the case of pensioners: pension statement

  • for self-employed persons:

    • Certificate of net income from the tax advisor or tax consultant

    • Trade register excerpt or printout from the commercial register


  • for associations: Proof of the association's assets


The Immigration Office may request further proof, such as proof of sufficient living space.
